I am looking for some sort of shopping cart CMS wheres users can upload digital goods, set there price. Once bought, I would get a % of the purchased product would be sent to me then the rest would be sent to them.

THe digital good should be able to be emailed to them. (this part isn't required)

Ubercart has some capabilities for selling files, so it should be doable. Sending the files by e-mail would require some programming I think.
The whole payment thing does not exist yet, but it might be possible to program it.

You will definitely need to upgrade ubercart for your purposes.
