In orders, I see that there is a box that says "Customer does not want marketing emails" or something like that.

I can't find where they would set this? There's nothing in the registration, and nothing in the checkout. And I can't find anything related to it in the administration menus.

Hmm... pretty sure that's part of Google Checkout, something they possibly specify on the Google side.

Correct. Google requires this information to be visible in the order administration, and any site that wants to send out emails to its customer base needs to respect that setting in order to comply with Google's policies. I don't actually know of any email modules that would get the email addresses from the orders, so it might not be important.

What I don't quite understand is a) I'm not using Google checkout, and b) I can see no where as I have tested checkout where one choose to receive or not receive marketing emails.

It's like if you are not using Google checkout, then it automatically goes to no.

???

And not only that. I'm looking under checkout settings and the option isn't even there, but it's showing up in my invoices.

Even if you aren't using Google Checkout, you probably still have the module enabled. Customers generally only say they wish to receive marketing emails through the Google Checkout interface, so it provides the pane that displays their choice. If you don't plan on using Google Checkout, you should disable the module, and the pane will disappear from the order and invoice pages.
